B C Manjunath is a world-renowned Mridangam virtuoso and Konnakkol maestro whose contributions have elevated the art of rhythm to international acclaim. Born into a family of musicians, Manjunath trained under legendary gurus Karnataka Kalasree K N Krishna Murthy and Sangeetha Kalanidhi Dr. T K Murthy. With an “A” grade from All India Radio and the prestigious Asthana Vidwan title, Manjunath has received accolades like the Ustad Bismillah Khan Yuva Puraskar from the Sangeet Natak Akademi.

TERMS OF SERVICE

These Terms of Service (“Terms”) govern your use of the Ta Ka Di Mi app, a rhythm-learning application powered by AI, owned and operated by Shaale Private Limited. By accessing or using the app, you agree to these Terms.

 

1. Eligibility

You must be 6 years or older to use the app. 

2. Use of AI/ML Features

The app uses AI to provide personalized feedback. While we strive for accuracy, AI-generated insights may vary and should not be solely relied upon for professional training or decision-making.

 

3. Account and Security

You are responsible for maintaining the confidentiality of your account credentials. Unauthorized use of your account must be reported immediately.

 

4. Prohibited Activities

You agree not to misuse the app, including but not limited to reverse engineering, unauthorized data scraping, or attempting to exploit vulnerabilities.

5. Intellectual Property

All content within the app, including challenges, AI algorithms, design, and data, is the intellectual property of Shaale Private Limited.

6. Limitation of Liability

The app is provided “as is.” Shaale Private Limited is not liable for any damages arising from the use or inability to use the app.

 

7. Modification of Terms

Shaale reserves the right to update these Terms at any time. Continued use of the app constitutes acceptance of the revised Terms.

END USER LICENSE AGREEMENT

This End-User License Agreement (“Agreement”) is a legal agreement between you (“End-User”) and Shaale Private Limited for the use of the Ta Ka Di Mi app (“Licensed Application”). By downloading, installing, or using the Licensed Application, you agree to the terms of this Agreement.

 

1. Acknowledgment

This Agreement is between Shaale Private Limited and you, the End-User, and not with Apple or Google. Shaale Private Limited is solely responsible for the Licensed Application and its content. This Agreement must not conflict with the Google or Apple Media Services Terms and Conditions, which you acknowledge having reviewed.

 

2. Scope of License

Shaale Private Limited grants you a non-transferable license to use the Licensed Application on any mobile device that you own or control, as permitted by the Usage Rules in the Google or Apple Media Services Terms and Conditions. The Licensed Application may also be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.

 

3. Maintenance and Support

Shaale Private Limited is solely responsible for providing maintenance and support for the Licensed Application. Google or Apple has no obligation to provide maintenance or support services for the Licensed Application.

 

4. Warranty

Shaale Private Limited is solely responsible for any warranties, whether express or implied by law. In the event of any failure of the Licensed Application to conform to an applicable warranty, you may notify Google or Apple for a refund of the purchase price. To the maximum extent permitted by law, Google or Apple will have no other warranty obligation with respect to the Licensed Application, and Shaale Private Limited will be responsible for all other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty.

 

5. Product Claims

Shaale Private Limited, not Google or Apple, is responsible for addressing any claims by you or a third party relating to the Licensed Application, including but not limited to:

• Product liability claims,

• Any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement, and

• Claims arising under consumer protection, privacy, or similar legislation.

 

6. Intellectual Property Rights

In the event of any third-party claim that the Licensed Application or your possession and use of the Licensed Application infringes on a third party’s intellectual property rights, Shaale Private Limited, not Google or Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

 

7. Legal Compliance

You represent and warrant that:

1. You are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a “terrorist supporting” country, and

2. You are not listed on any U.S. Government list of prohibited or restricted parties.

9. Third-Party Terms of Agreement

The End-User must comply with applicable third-party terms of agreement when using the Licensed Application, such as their wireless data service agreement.

 

10. Third-Party Beneficiary

You and Shaale Private Limited acknowledge and agree that Google or Apple are third-party beneficiaries of this Agreement. Upon your acceptance of this Agreement, Google or Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary.
